Pension contribution periods for medium disability: assimilated and pre-2001 seniority included in full stage
Legislator summary
AI generatedThe High Court of Cassation and Justice, acting as the complete panel for resolving legal questions, issued a binding preliminary ruling that admitted the referral from the Bucharest Court of Appeal and established that, under Article 58(c) of Law No. 263/2010, the full contribution period required for medium-disability beneficiaries includes both assimilated periods defined in Article 49(1)(b) and (c) and supplementary seniority periods granted for work in Group I or II prior to April 1, 2001, pursuant to Article 17(1). The dispute concerned the interpretation of pension legislation regarding which specific periods count toward the mandatory contribution threshold for disability pensions, specifically whether non-contributory or special-condition work periods are eligible for inclusion in the calculation. The decisive legal basis is the joint application of Articles 58(c), 49(1)(b)-(c), and 17(1) of Law No. 263/2010 on the unified public pension system, clarifying that these diverse categories of service time collectively satisfy the statutory requirement for a complete contribution stage.
