The High Court of Cassation and Justice admitted the referral from the Buzău Tribunal and issued a binding preliminary ruling for the uniform interpretation of Article 628(4) of the Romanian Civil Procedure Code, holding that the enforcement court may determine interest, penalties, or other sums due by operation of law to the creditor under Article 1,535 of the Civil Code or other special legal provisions, even when the creditor requests contractual late-payment penalties. The dispute arose in an enforcement proceeding where the creditor sought contractual penalties, and the referral questioned whether such sums fall within the court's competence to establish. The ruling is mandatory under Article 521(3) of the Civil Procedure Code.
