The High Court of Cassation and Justice admitted the appeal in the interest of law filed by the Board of Directors of the Suceava Court of Appeal, establishing a binding legal interpretation that prevails over prior inconsistent rulings. The dispute concerned the application of Article 103(1)(d) of Emergency Government Ordinance No. 195/2002 regarding public road traffic, specifically challenging the definition of "bodily injury" in the context of administrative sanctions for traffic offenses. The court decisively ruled that, under the version of the ordinance in force until June 29, 2024 (prior to amendments introduced by Emergency Government Ordinance No. 84/2024), the term "bodily injury" is legally defined as traumatic lesions or health impairment whose severity is evaluated by requiring at least one day of medical care, thereby standardizing the threshold for such legal consequences across the jurisdiction.
