Appeal allowed: claimant's renunciation of property rights annuls appellate judgment on merits
Legislator summary
AI generatedThe Romanian High Court of Cassation and Justice (Second Civil Section) allowed the appeal and, under Article 247(5) of the Code of Civil Procedure, annulled in its entirety the Court of Appeal Bucharest's judgment of 25 June 2003, which had rejected the claimant's action; the appellate court took note of the claimant's express renunciation of the asserted right, making the annulment final and irrevocable. The underlying dispute was an action brought by a company against the state assets recovery authority seeking a declaration that certain buildings and land (warehouse, scale cabin and bridge, yeast basin, and a surface at a "winery" point) had belonged to a former state farm and were not covered by a mortgage contract authenticated in 1996, with an order to strike the mortgage. The legal basis was the procedural rule allowing a litigant to abandon the substantive right claimed during appeal, which mandates vacating the lower court's decision on the merits.

SC M.I.L.
