The High Court of Cassation and Justice declared the appellant’s appeal (recourse) perempted, thereby leaving the judgment of the Court of Appeal of Craiova as the final operative outcome in favor of the respondent. The dispute involved a procedural challenge in administrative and fiscal litigation, where the appellate proceedings were initially suspended in May 2022 due to the unjustified absence of the parties without a request for judgment in absentia, and a subsequent request to resume the proceedings in November 2022 was rejected because the appellant failed to pay the required stamp duty. The court applied Article 416(1) of the Code of Civil Procedure, finding that the case remained in a state of non-activity for more than six months attributable to the appellant, and no procedural acts were performed to interrupt or suspend peremption under Articles 417–418, leading the court to declare the appeal perempted ex officio pursuant to Article 420(1).

Şedinţa publică din data de 21 martie 2024

Asupra cererii de faţă;

Din examinarea lucrărilor din dosar, constată următoarele:

420 alin. (1) din C. proc. civ. şi va constata perimată cererea de recurs.
