The High Court of Cassation and Justice, in its Specialized Panel for Resolving Questions of Law in Criminal Matters, decided the preliminary question of law, establishing that the material element of the crime of corrupting public tendering (Article 246 of the Penal Code) is not satisfied when the perpetrator themselves withdraws from a public tender through corrupt means. This decision resolves a legal dispute regarding the interpretation of "removal" as a mode of corrupting the tendering process, clarifying that self-removal via corruption does not constitute the specific modality of removal required by the statute. The court ruled that the crime is not established in such scenarios, a ruling that is mandatory from the date of publication in the Official Monitor of Romania, Part I, pursuant to Article 477(3) of the Code of Criminal Procedure.
