The High Court of Cassation and Justice, in a consolidated panel for resolving issues of law, issued a binding interpretation stating that employers in the metal construction industry (CAEN 2511) are entitled to apply specific tax exemptions only for activities directly linked to the construction sector as defined in Order No. 337/2007, and that prior determinations by a labor inspection authority regarding the minimum salary for the construction sector do not constitute a legal basis for the tax authority to recognize such tax benefits. This decision resolved a reference submitted by the Court of Appeal in a tax and administrative litigation case, clarifying the scope of tax facilities under Articles 60(5), 1381, and 154(1)(r) of the Fiscal Code (Law No. 227/2015) and the procedural implications of Article 13(6) of the Fiscal Procedure Code, thereby establishing that the lack of a direct connection to defined construction activities precludes the application of these specific tax incentives regardless of other administrative findings.

În interpretarea şi aplicarea dispoziţiilor art. 60 alin. (5), ale art. 1381 şi ale art. 154 alin.
