The High Court of Cassation and Justice, in a binding decision for legal unification, admitted the referral from the Covasna County Court and held that active teaching staff who perform additional hourly-paid work at the same pre-university educational unit through cumulative employment contracts do not have the right to paid annual leave or the corresponding compensation for unexercised leave for that specific hourly work period. The dispute concerned the interpretation of labor and education laws regarding the scope of paid leave entitlements for teachers engaged in both standard and cumulative hourly contracts. The decisive legal basis comprises the interpretation of Article 106(1), Article 144, and Article 146(3) of the Labor Code, read in conjunction with Articles 220(1) and (5) of Law No. 198/2023 on pre-university education, Articles 267(1) and 270 of National Education Law No. 1/2011, and Article 5(1) of the Methodological Norms approved by Ministry of Education Order No. 4,050/2021, establishing that the leave benefits under the general labor framework do not extend to the cumulative hourly compensation arrangement.
