The High Court of Cassation and Justice, through its Panel for Resolving Issues of Law, issued a binding mandatory interpretation stipulating that, when determining the maximum salary level for similar public sector positions, employers must exclude salary rights previously granted to other employees via final court judgments if those judgments relied on legal norms subsequently invalidated by a mandatory ruling of the High Court; the court resolved the legal question raised by the Bucharest Court of Appeal regarding the application of Articles 39(1) and (4) read in conjunction with Article 6(a)–(c) of Law No. 153/2017 on the salarization of public-funded personnel, establishing that outdated judicial interpretations of general legal norms cannot distort the statutory calculation of maximum salary ceilings for comparable functions.
