The High Court of Cassation and Justice admitted the appeal in the public interest filed by the Board of Appeal of the Brașov Court of Appeals and established a binding legal interpretation regarding the interruption of the criminal statute of limitations. The case concerned the procedural status of acts that interrupt the statute of limitations in cases involving crimes against EU financial interests and corruption, specifically whether such acts issued before or after specific legislative changes remain effective depending on which version of criminal law is deemed more favorable. The Court ruled that acts of procedure issued before June 25, 2018 (the publication date of Constitutional Court Decision 297/2018) interrupt the statute of limitations regardless of the value of the damage, without requiring a concrete systemic risk assessment, provided that the more favorable criminal law is the Penal Code or special legislation in force between February 1, 2014, and June 24, 2018; conversely, acts requiring communication to the suspect or defendant after May 30, 2022 (the publication date of Emergency Ordinance No. 71/2022) only interrupt the statute of limitations for offenses committed on or after that date, or for prior offenses only if the more favorable law is the version in force on or after May 30, 2022, as determined by the global application of Constitutional Court Decision 265/2014. The decision is mandatory from the date of publication in the Official Monitor, pursuant to Article 474(4) of the Code of Criminal Procedure.
