The High Court of Cassation and Justice admitted the appeal in the interest of the law filed by the General Prosecutor, establishing a binding interpretation that the crime of embezzlement committed by an employee (under Penal Code Art. 295(1) with the application of Art. 308(1)) does not constitute a "property crime" for the purposes of jurisdictional allocation under Criminal Procedure Code Art. 152(1)(a) in relation to Art. 139(2). The proceeding was a judicial review of legal interpretation aimed at resolving inconsistencies in the classification of specific financial offenses regarding their procedural categorization. The court relied on the mandatory legal interpretation powers under Criminal Procedure Code Art. 474(4) to clarify that this specific form of embezzlement is excluded from the definition of property crimes, thereby determining the competent jurisdiction or procedural pathway for such cases.
