Withdrawal of complaint for procedural delay due to late issuance of reasoned judgment
Legislator summary
AI generatedThe Supreme Court of Romania's High Court of Cassation and Justice accepted the withdrawal of a complaint regarding procedural delay, leaving no operative ruling on the merits and ending the specific proceeding without prejudice to the underlying case. The dispute arose when a plaintiff filed a complaint with the Supreme Court alleging that the Court of Appeal Bucharest had failed to render the reasoned judgment in a civil case within the statutory deadline; subsequent to filing the complaint, the plaintiff submitted a request to withdraw it on the grounds that the lower court had finally drafted the judgment. The court’s decision was based on Article 523 of the Civil Procedure Code, which permits the unilateral withdrawal of a complaint at any time prior to its adjudication as an exercise of the party's right of disposition under Article 9 of the same Code, resulting in the court merely taking note of the withdrawal.
