Survivor spouse keeps military pension benefits as appeal annulled for filing with wrong court
Legislator summary
AI generatedThe court annulled the appeal filed by the county pension house against the lower court's judgment, leaving that judgment in force and thereby upholding the claimant's victory. The dispute concerned a survivor's spouse seeking annulment of the pension authority's decision and recognition of her entitlement to benefits under Law No. 309/2002 based on her deceased husband's military labor service; the appellate court had granted her claim, holding that the husband fell within the law's scope and that Article 3 extended the rights to the surviving spouse. The High Court of Cassation and Justice did not reach the merits, instead declaring the appeal null because it was filed with the wrong court (the tribunal) rather than with the court that issued the challenged decision, a defect sanctioned by nullity under Article 302 of the Civil Procedure Code.

Asupra recursului de față;
