The Romanian High Court of Cassation and Justice, sitting as a panel for the preliminary resolution of legal questions in criminal matters, admitted the referral from the Bucharest Military Court of Appeal and ruled that, under Article 85(2)(g) of the Criminal Code, a court cannot impose on a person granted a deferral of sentence application a driving ban for certain vehicles for a period shorter than the full supervision period set under Article 84 of the Criminal Code. The decision is binding from publication in the Official Gazette. The dispute involved an interpretive question in a criminal case where a court sought to impose a temporary driving prohibition as a supervision obligation, and the court held that such an obligation must cover the entire supervision term, not a lesser duration, based on the statutory text and the structure of the deferral regime.
