The High Court of Cassation and Justice dismissed the request for a preliminary ruling as inadmissible, leaving the proceedings pending before the Bihor County Court unchanged. The dispute arose from a referral by the lower court concerning the procedural status of a civil case suspended facultatively under Article 413(1)(1) of the Code of Civil Procedure, specifically questioning whether the suspended case is automatically resumed by the court or requires a party's motion, and whether the lapse of six months without such a motion triggers the peremption of the claim or appeal against parties not involved in the dependency case. The decisive legal issue involved the interpretation of Articles 413(1)(1), 415(3), and 416(1) and (3) of the Code of Civil Procedure regarding the resumption of proceedings and the effects of peremption in cases with partial party overlap.
