The High Court of Cassation and Justice (Înalta Curte de Casaţie şi Justiţie), sitting in a panel for preliminary rulings, admitted the referral from the Bucharest Court of Appeal and established a binding interpretation: where a criminal conviction results from an accepted guilt-plea agreement and the defendant fully pays the civil party's claims under art. 10(1) of Law no. 241/2005 on preventing and combating tax evasion (as in force on 20 November 2018), the criminal judgment has res judicata authority over the extent of the damage in subsequent civil proceedings, and art. 486(2) of the Criminal Procedure Code does not apply. The dispute concerned the interplay between these provisions in a tax-evasion case involving a plea agreement; the Court ruled that the civil court is bound by the damage amount fixed in the criminal conviction, rejecting any contrary reading of the procedural code. The decision is mandatory for all courts under art. 521(3) of the Civil Procedure Code.
