The High Court of Cassation and Justice, acting as the complete for resolving legal questions, issued a binding interpretation (mandatory for all lower courts) clarifying the scope of beneficiary rights under the Romanian regime for persecuted persons. The dispute, referred by the Constanța Tribunal in two separate fiscal administrative litigation cases, concerned whether children of individuals persecuted during the period from September 6, 1940, to March 6, 1945, were eligible for state benefits if they were not yet conceived at the time of their parents' expulsion or displacement. Relying on a strict reading of Article 31(3) of Government Ordinance No. 105/1999, the court ruled that only children who were born or at least conceived on the specific date of the refugee event, expulsion, or relocation into another locality are eligible for these rights, effectively excluding those conceived after the specified historical events.
