The High Court of Cassation and Justice, through its Complete Panel for Resolving Issues of Law, resolved a preliminary question raised by the Bucharest Court of Appeal, determining that specific provisions of the Romania-Ukraine Treaty on legal assistance are not applicable to requests for the reacquisition of Romanian citizenship. This ruling clarifies that such procedures, conducted by the National Authority for Citizenship and finalized by administrative acts subject to administrative litigation, fall outside the scope of Article 13 and Article 40(2) of the 2002 bilateral treaty, particularly for cases decided prior to the entry into force of Emergency Ordinance No. 82/2021. The decision mandates that the treaty’s legal assistance provisions cannot be invoked to challenge or adjudicate these specific administrative acts, thereby establishing the exclusive jurisdiction of the administrative courts for these matters based on domestic law rather than international treaty mechanisms.
