Peremption of appeal due to six-month procedural inaction following suspension of proceedings
Legislator summary
AI generatedThe High Court of Cassation and Justice declared the appellant’s recusal proceedings perished, effectively leaving the underlying administrative decision of June 8, 2022, in force as the final resolution. The case involved a legal appeal against that administrative decision, which was suspended on December 5, 2022, due to the absence of the parties. The court applied the legal doctrine that the six-month period for *perimare* (perishing of the right to action) runs from the date of the suspension order or the last procedural act if the case remains in stasis due to imputable inaction by the parties. Relying on Articles 416(1), 417, and 420(1) of the Civil Procedure Code, the court determined that no procedural acts were performed within the statutory six-month window, which expired on June 6, 2023, thus mandating the automatic extinction of the appeal without examining the merits.

Asupra recursului;
420 alin. (1) coroborat cu art. 416 alin. (1) din C. proc. civ., Înalta Curte va constata perimată cererea ce formează obiectul prezentei cauze.
