Binding interpretation confirms exclusion of cumulative doctorate allowance and first teaching degree salary for pre-2017 appointments
Legislator summary
AI generatedThe High Court of Cassation and Justice, in its complete bench for resolving legal issues, admitted a referral from the Iasi Court of Appeal and established a binding legal interpretation, determining that the exclusion of cumulative payments between the monthly allowance for a scientific doctorate title and the salary associated with the first teaching degree (based on that same title) applies uniformly to academic staff who had been granted the first teaching degree prior to the entry into force of Law No. 153/2017, based on Article 36(3) of Law No. 128/1997. The dispute concerned the conflict between prior statutory provisions regarding the formation of teaching staff and subsequent salary regulations, with the court clarifying the scope of application for salary limitations in public sector employment. The decisive legal basis for this ruling is the joint application of Article 14(3) and Article 39(5) of Framework Law No. 153/2017 concerning the salarization of personnel paid from public funds, which mandates that the salary for the first teaching degree obtained via a doctorate title does not accumulate with the specific doctorate allowance, thereby overriding previous interpretations that allowed such accumulation for pre-2017 appointments.
