The Supreme Court admitted the appeal in the interest of the law filed by the Court of Appeal leadership and established binding jurisprudence, ruling that the filing of a contraventional complaint does not exclude the application of the right to withdraw the complaint under Article 204(1) of the Civil Procedure Code. The dispute concerned the procedural rights available to a plaintiff or complainant in contravention cases, specifically whether specific regulatory provisions barred the withdrawal of the claim. The decisive legal basis is the interpretation of Article 31(1) of Government Emergency Ordinance No. 2/2001 regarding the legal regime of contraventions, read in conjunction with Article 204(1) of the Civil Procedure Code, confirming that general procedural rights regarding the withdrawal of complaints remain applicable unless explicitly derogated by specific statutory law.
