The High Court of Cassation and Justice, through its Plenary for Recourse in the Interest of Law, admitted the recourse filed by the Prosecutor General and established a binding legal interpretation regarding international recidivism. The decision resolved the procedural dispute over whether a final foreign criminal conviction can be considered for domestic recidivism purposes based solely on data from the European Criminal Records Information System (ECRIS). The court ruled that under Article 41(3) of the Penal Code, international recidivism applies only after the specific procedure for recognizing the foreign judgment under Article 147 of Law No. 302/2004 is completed on an incidental basis, explicitly prohibiting reliance on ECRIS mentions alone. This ruling is obligatory and applicable across all jurisdictions pursuant to Article 474(4) of the Code of Criminal Procedure.
