The High Court of Cassation and Justice, acting in a public session, admitted an appeal in the public interest filed by the Court of Appeal Board of Suceava and established a binding interpretation regarding the right to monthly compensation for rent or credit repayments. The dispute concerned whether police officers could claim this specific benefit under Article 31(12) of the Police Statute Law No. 360/2002, as amended by Law No. 288/2018, particularly for those who had entered into mortgage or real estate credit contracts prior to the entry into force of the 2018 legislation. Relying on the provisions of Article 31(12) of Law No. 360/2002 and Article 517(4) of the Civil Procedure Code, the court ruled that the right to monthly compensation for credit repayments cannot be granted to police officers who executed their mortgage or real estate credit contracts before the effective date of Law No. 288/2018.
