The High Court of Cassation and Justice (ICCJ) admitted a reference in the interest of the law raised by the Board of Appeal Cluj and established that material jurisdiction over disputes concerning the execution of public procurement contracts, registered with courts after the entry into force of the amendments introduced by Law No. 208/2022 (specifically on or after September 10, 2022), lies with the administrative and fiscal court division of the court of appeal. This ruling resolved a jurisdictional conflict regarding the proper forum for post-award litigation in the public procurement sector, determining that such cases must be handled by specialized administrative courts rather than commercial divisions following the legislative update. The decision is grounded in the interpretation of Article 53(1) and 53(11) of Law No. 101/2016 regarding remedies and means of appeal in public procurement, and Article V(3) of Law No. 208/2022, which amended the relevant public procurement framework, and is binding on all judicial bodies under Article 517(4) of the Civil Procedure Code.
