Binding interpretation requiring transfer of civil cases at appellate or cassation stage to be decided by the specific judicial panel prescribed for that procedural level
Legislator summary
AI generatedThe High Court of Cassation and Justice, acting as the panel for appeals in the interest of the law, admitted the appeal filed by the leadership of the Cluj Court of Appeal and issued a binding, mandatory interpretation regarding procedural composition. The dispute concerned the correct judicial panel required to adjudicate a request for the transfer (strămutare) of a civil case that was already in the appellate or cassation stage. The court established that such transfer requests, which fall within the jurisdiction of the court of appeal, must be decided by the specific composition of judges prescribed by law for the respective procedural stage (appeal or cassation), rather than a default panel. This decision is grounded in Articles 142 and 144 of the Civil Procedure Code, read in conjunction with Article 59 of Law No. 304/2022 on the organization of the judiciary, and serves to ensure uniform application of the law under Article 517(4) of the Civil Procedure Code.
