The High Court of Cassation and Justice (Romania), sitting as a panel for preliminary ruling on questions of law, admitted the referral from the Suceava Court of Appeal (administrative and fiscal section) and held that, interpreting Article 25, second thesis, of Emergency Ordinance No. 59/2000, the right to the monthly non-taxable allowance of 30% of the average gross salary is sufficiently well-determined in the absence of implementing regulations or methodological norms setting out conditions and criteria for granting service housing to forestry personnel; it further held that the phrase "in the locality where the activity is carried out" refers to the locality where the organizational structure of the employing institution, designated as the workplace, is located. The decision is binding under Article 521(3) of the Civil Procedure Code.
