Veterinary-sanitary transitional provisions apply absent implementing norms; appeal admitted and binding interpretation set.
Legislator summary
AI generatedThe High Court of Cassation and Justice admitted the appeal in the interest of the law filed by the Ombudsman and established, as binding under Art. 517(4) of the Civil Procedure Code, that the provisions of Art. IV(1) of Law No. 236/2019 (amending Art. 15 of Government Ordinance No. 42/2004 on veterinary-sanitary activity and food safety) apply even though the executive branch had not adopted the implementing methodological norms required by Art. V of that law, for the period 16 December 2019–23 July 2020. The dispute concerned the uniform interpretation of transitional statutory provisions whose application had been conditioned on the adoption of secondary legislation. The court ruled that the substantive amendment took direct effect from its entry into force, and the absence of the methodological norms did not suspend its applicability during the specified interval.
