The High Court of Cassation and Justice, sitting in its panel for appeals in the interest of the law, admitted the appeal filed by the General Prosecutor, establishing binding interpretive principles for the unitary application of Article 301 of Law No. 302/2004. The dispute concerned the correct legal basis for calculating the statute of limitations for the execution of pecuniary sanctions (penal or administrative fines) imposed by authorities of EU member states and subsequently recognized by Romanian judicial authorities. The Court ordered that the applicable legal framework for the limitation period depends on the nature of the sanction, requiring the application of either the Penal Code or the Fiscal Procedure Code, and decisively established that the limitation period begins to run from the date the foreign judgment rendered the sanction final and binding, rather than from the date of the Romanian recognizing judgment.
