The High Court of Cassation and Justice (Completul pentru soluționarea recursului în interesul legii) admitted the public prosecutor's appeal, establishing a mandatory, unitary interpretation that the territorial competence of the enforcement court may be determined by the secondary seat of the debtor's branch when the enforcement title concerns a branch without legal personality. This decision resolves a procedural dispute regarding the proper venue for civil enforcement actions, specifically addressing whether a non-legal-entity branch's location can anchor jurisdiction instead of the main headquarters. The court grounded its ruling in the unified interpretation of Article 651(1) of the Civil Procedure Code and declared the decision obligatory pursuant to Article 517(4) of the same Code.
