The High Court of Cassation and Justice dismissed as inadmissible the appeal in the interest of the law filed by the leadership board of the Court of Appeal, meaning the challenged interpretation was not reviewed and no substantive ruling was issued on the merits. The dispute concerned the uniform interpretation and application of specific provisions in Law No. 130/2015, which amended Law No. 567/2004 governing the status of auxiliary specialist staff in judicial and prosecutorial institutions, specifically whether such staff were required to formally submit a request to receive service pension benefits during periods when they were already receiving pensions under the previous legal framework of Law No. 567/2004. The court’s decision was grounded in procedural ineligibility standards, applying Article 517 paragraph (4) of the Code of Civil Procedure to establish that the appeal was not admissible, thereby upholding the procedural threshold requirements for such appeals without addressing the substantive pension eligibility question.
