The High Court of Cassation and Justice rejected as inadmissible the reference for a preliminary ruling submitted by the Court of Appeal of Pitești regarding the interpretation of specific wage calculation phrases in Article 85(2) of Law No. 303/2004 on the status of judges and prosecutors, effectively leaving the lower court’s position to determine the application of the norms without binding higher-court clarification. The dispute centered on the correct calculation of gross monthly allowances for judges and prosecutors, specifically concerning the inclusion of seniority surcharges and other bonuses in the base calculation following the entry into force of Framework Law No. 153/2017 on public salary regimes. The decisive legal basis for the rejection was the procedural framework under Article 521(3) of the Civil Procedure Code, which the Complete Bench for Resolving Questions of Law applied to dismiss the challenge to the statutory interpretation of salary components under the judicial and prosecutorial status laws.
