The High Court of Cassation and Justice dismissed as inadmissible the referral for an interpretation of law submitted by the Braila County Court, thereby failing to resolve whether judgments annulling decisions by the Financial Non-Banking Alternative Dispute Resolution entity (SAL-FIN) are subject to appeal. The dispute concerned the procedural admissibility of a motion seeking a prior ruling on the scope of the appellate remedy under Civil Procedure Code Articles 94 and 466, read in conjunction with Article 9(9) of Annex 2 to ASF Regulation 4/2016 governing SAL-FIN procedures. By rejecting the referral, the supreme court left the lower court's procedural position unchanged, with the decision being mandatory and binding pursuant to Article 521(3) of the Code of Civil Procedure.
