Material jurisdiction of judicial control instance: application of first-instance specialization and nature of dispute in appellate proceedings
Legislator summary
AI generatedThe High Court of Cassation and Justice of Romania admitted the appeal in the interest of the law filed by the Presiding Council of the Court of Appeal of Galați, establishing a binding interpretation regarding procedural competence. The dispute concerned the determination of the material jurisdiction of the judicial control instance in appellate proceedings, specifically addressing how specialized structures should be applied when the first instance lacked such differentiation. The court ruled that the material competence of the judicial control instance is determined by strictly respecting the specialization of the first instance (board/section) in the appeal path, or, where the first instance had no specialized structures, by considering the subject matter and nature of the dispute as established by that lower court. This decision is based on the unitary interpretation of Articles 129(2)(2), 130(2), 131(1), 133, and 136 of the Code of Civil Procedure and is mandatory for all courts pursuant to Article 517(4) of the Code of Civil Procedure.
