The High Court of Cassation and Justice dismissed as inadmissible the reference for a preliminary decision submitted by the Court of Appeal of Bucharest, thereby denying the interpretation request and leaving the lower court to resolve the issue. The dispute concerned the interpretation of Article 31(1), point 2 of Law No. 360/2002 regarding the Status of the Police, specifically whether a special-status police officer who contracted a mortgage for housing acquisition prior to the entry into force of Law No. 288/2018 (effective December 9, 2018) could benefit from the monthly rent compensation for paying the mortgage installment starting from the date the new law came into force. The decision rests on the procedural inadmissibility of the reference under the Civil Procedure Code, failing to establish a preliminary ruling on the substantive scope of the legislative amendment regarding housing subsidies for police officers with pre-existing mortgage contracts.
