The High Court of Cassation and Justice rejected the referral for a preliminary ruling as inadmissible, thereby denying the request to resolve the legal question and leaving the underlying civil dispute to proceed without a binding uniform interpretation from the supreme court. The referral was initiated by a court of appeal to determine whether the legal provisions of Decree-Law No. 118/1990, which conferred veteran or combatant status for service during World War II, extended to individuals who had been conscripted into the Hungarian army and subsequently captured as prisoners of war by the Soviet forces after August 23, 1944. The decisive procedural basis for the dismissal was the court's determination that the submitted question did not meet the admissibility requirements for a preliminary ruling under the relevant provisions of the Civil Procedure Code, specifically Article 521(3), preventing the establishment of a new jurisprudence on this specific interpretive issue.
