The High Court of Cassation and Justice dismissed as inadmissible the referral from the Alba Tribunal (Civil Section I) for a preliminary ruling on interpreting Article 27(23) of Land Fund Law No. 18/1991, with the dismissal being binding under Article 521(3) of the Civil Procedure Code, and the prior decisions in the underlying case remain in force. The referral arose in a civil case involving a challenge to land restitution procedures, where the tribunal sought clarification on the application of the cited provision. The court held that the referral failed to meet the admissibility requirements for a preliminary ruling, as the question did not present a genuine difficulty or novelty warranting a unified interpretation, thereby declining to rule on the substantive legal issue.
