The High Court of Cassation and Justice issued a mandatory preliminary ruling, admitting the referral from the Court of Appeal of Suceava and establishing that a right to choose between an invalidity pension and a partial early retirement pension is not excluded when the statutory conditions for the latter are met. The dispute concerned the interpretation and application of the unified public pension system, specifically whether an individual could opt for a partial early retirement pension instead of an invalidity pension. The decisive legal basis involved the interpretation of Article 82(1) of Law No. 263/2010, read in conjunction with Article 79(1)(c) and Article 65(1) of the same legislation, determining that the law does not preclude the existence of such an election right for beneficiaries meeting the relevant criteria.
