The High Court of Cassation and Justice, sitting as the Panel for Resolving Questions of Law, rejected as inadmissible the referral submitted by the Court of Appeal Pitești for a preliminary ruling on a question of law. The dispute concerned the method for updating the service pension of a judge holding a doctorate in law, specifically whether the 15% salary bonus is calculated based on the percentage at the time of retirement or the fixed amount established by the legislative framework for public sector salaries. The legal basis for the decision was the interpretation of Article 85(2) of Law No. 303/2004 regarding the status of judges and prosecutors, in conjunction with Article 14(1) of Framework Law No. 153/2017 concerning public sector salarization.
