Fiscal litigation: Scope of judicial review beyond administrative appeals and personal tax liability of deregistrations sole proprietors
Legislator summary
AI generatedThe High Court of Cassation and Justice admitted the referral from the Court of Appeal Iași and issued a binding preliminary ruling, clarifying that in tax administrative litigation, grounds for annulment are not limited to those raised in the prior administrative appeal and that the annulment of a tax obligation following the deregistration of a sole proprietor does not preclude the assumption of that obligation by the natural person under specific statutory conditions. The dispute concerned the procedural scope of judicial review for fiscal decisions and the liability of natural persons registered in commercial directories after deregistration. The court relied on Article 281(2) of the Fiscal Procedure Code in conjunction with Article 8(1) of the Administrative Litigation Law to establish the unrestricted scope of illegality claims, and on Article 266(41) of the Fiscal Procedure Code read alongside Article 23(3)-(4) to determine the persistence of personal tax liability despite deregistration.
