The High Court of Cassation and Justice admitted the referral from the Oradea Court of Appeal and issued a binding preliminary ruling interpreting Article 527(1) of the Administrative Code. The case involved a dispute in administrative and fiscal litigation concerning the treatment of income received by a public official during the period following the illegal termination of their service and prior to their effective reintegration. The court clarified that the statutory phrase "income obtained in the respective period" refers specifically to income earned legally through activities that replaced the public function and are connected to the unlawful cessation of the employment relationship. This interpretation is mandatory for lower courts pursuant to Article 521(3) of the Code of Civil Procedure, resolving the legal uncertainty regarding the scope of compensable or assessable income in such civil service disputes.
