The High Court of Cassation and Justice dismissed the connected referral cases filed by the Bucharest Court of Appeal as inadmissible, resulting in the lower court retaining jurisdiction to resolve the underlying civil disputes without a binding preliminary ruling. The court refused to address the procedural legal question of whether a fiscal invoice issued by a public utility operator to a public authority under a service management delegation contract constitutes an enforceable title for the purpose of executing civil proceedings. The decision is grounded in the procedural framework of Articles 521(3) of the Civil Procedure Code and the substantive provisions of Article 42(61) of Law No. 51/2006 on Public Utility Services, establishing that the referred questions did not meet the admissibility criteria required for a preliminary ruling by the full panel for legal interpretation.
