The High Court of Cassation and Justice, acting through the panel for solving appeals in the public interest, admitted the appeal filed by the Board of the Bucharest Court of Appeal and issued a mandatory, legally binding uniform interpretation. The dispute concerned the determination of material jurisdiction regarding civil claims seeking the confirmation of the illicit nature of facts infringing non-patrimonial rights, specifically when such claims are combined with requests for damages where the value does not exceed 200,000 lei. Relying on Article 253(1)(c) and (4) of the Civil Code, as well as Articles 94(1)(h) and (k) and 95(1) of the Code of Civil Procedure, the Court established that the tribunal is the competent material court of first instance to resolve these mixed cases, thereby standardizing the procedural application of these norms across the judicial system.
