Qualification of post-appointment mandatory military service as judicial length of service for public pension entitlements
Legislator summary
AI generatedThe High Court of Cassation and Justice of Romania issued a binding preliminary decision, dismissing the prior appellate court's uncertainty and ruling that the period of mandatory military service performed by a judge or prosecutor after their appointment to the magistracy constitutes service time in the magistracy for pension purposes. This decision resolved a reference from the Court of Appeal of Craiova regarding whether the service period incurred post-appointment qualified as "venchime" (length of service) for calculating public pension rights under the unified pension system. The court grounded its ruling in the interpretation of Article 82(2) and Article 86(1) of Law No. 303/2004 concerning the status of judges and prosecutors, read in conjunction with Article 49(1)(c) of Law No. 263/2010 on the unified public pension system and Articles 1 and 3(3) of Law No. 46/1996 on population training for defense, thereby establishing that such military service is legally recognized as continuous service for judicial and prosecutorial pension calculations.
