The High Court of Cassation and Justice dismissed as inadmissible the referral for a preliminary ruling submitted by the Timiș Tribunal regarding a civil dispute over a motor insurer’s right of recovery. The specific issue concerned whether the statute of limitations extension under Article 1.394 of the Civil Code applies to an insurer’s action in regression against the tortfeasor, founded on Article 25(lit. b) of Law No. 132/2017, in conjunction with Articles 1,597 and 2,528 of the Civil Code. The Court did not address the merits of the legal question, resulting in the rejection of the reference under Article 521(3) of the Code of Civil Procedure, leaving the underlying procedural status unchanged by this higher court intervention.
