The High Court of Cassation and Justice, acting through its Panel for Resolving Legal Issues, dismissed as inadmissible the reference for pre-notice decision filed by the Bucharest Court of Appeal. The reference concerned a dispute over the procedure for restoring the previous situation when goods subject to enforcement have been valued, specifically challenging whether the fiscal procedural code provision allowing restoration only via the return of the debtor's share of the proceeds derogates from the common law civil procedure provision. The Court found the submission inadmissible without addressing the substantive legal question, leaving the lower court's procedural posture unchanged and rejecting the attempt to clarify the hierarchy between the specific fiscal enforcement rule and the general civil enforcement norm.
