Eligibility of adopted children for political persecution benefits of biological parents under Decree-Law No. 118/1990
Legislator summary
AI generatedThe High Court of Cassation and Justice, acting as the Plenary for the Resolution of Legal Questions, issued a binding precedent ruling that an adopted child is not excluded from receiving survivor benefits based on their biological parent's political persecution. This decision resolved a referral from the Arad Court of Appeal regarding the interpretation of Decree-Law No. 118/1990, specifically addressing whether the establishment of legal filiation through adoption extinguishes a child's entitlement to social rights derived from the biological parent's status as a political victim. The court held that under Article 5(6) of the Decree-Law, the adoption by other individuals does not negate the child's right to benefits associated with the biological parent's persecution, thereby clarifying that the legal basis for the claim rests on the biological link rather than the current legal custody status.
