The High Court of Cassation and Justice dismissed the civil appeal in recusal as unfounded, thereby upholding the Court of Appeal's decision that rejected the municipality's appeal against the lower court's judgment. The case involved a lease termination and eviction action initiated by the local council against a tenant for non-payment of rent, where the trial court had ordered the defendant to pay 1.51 million lei in arrears and penalties, terminated the lease agreement dated October 20, 1999, and ordered the eviction of the occupants. The appellant challenged the partial admission of the claim, arguing the total debt was higher (4.98 million lei) and that the allocated court costs were insufficient, while also alleging a procedural defect due to missing signatures on the appellate decision. The Supreme Court held that the trial court correctly limited the judgment to the amount specified in the mayor's office certificate of debt and that the appellate decision was validly signed, thus maintaining the trial court's application of Article 24(b) of Law no. 114/1996 regarding lease termination for arrears exceeding three months and Article 274 of the Civil Procedure Code for the partial recovery of litigation costs.
