Refugee pension rights under Law 189/2000; mootness due to post-appellate administrative recognition of status
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed the appeal filed by the pension administration, leaving in force the lower court’s judgment that ordered the issuance of a new decision recognizing the claimant’s rights under Government Ordinance No. 105/1999 (approved by Law No. 189/2000) for the specified period. The dispute concerned the refusal to acknowledge the applicant’s status as a refugee from Bulgaria under the relevant refugee protection legislation, with the administrative entity arguing the applicant was in the country prior to the 1940 Treaty of Craiova. The Supreme Court found the appeal unfounded and lacking in object, noting that a subsequent commission decision dated September 23, 2004, had already recognized the individual’s status as a refugee and beneficiary of the law, thereby rendering the challenge moot; the dismissal was grounded in Article 312 of the Code of Civil Procedure regarding unfounded appeals.

Asupra recursului de față;
312 C. proc. civ.
