The High Court of Cassation and Justice admitted the appellant's appeal, reversed the lower court's dismissal, and ordered the pension house to issue a new decision recognizing the appellant as a beneficiary of Law No. 189/2000 (specifically Art. 1 lit. c) for the period March 1942 to August 1944, effective from December 17, 2003, thereby prevading the claimant. The dispute centered on an administrative challenge to a pension authority's refusal to grant compensation for ethnic persecution, where the appellant argued she had been forced to flee to a different county during that period; the lower courts had initially rejected the claim due to insufficient proof of the persecution and identity linkage to her father. The Supreme Court found the appeal founded based on newly submitted evidence, including a notarial declaration and a refugee registry extract, which established the factual basis for the compensation under the specified law.

Asupra recursului de față;
