The High Court of Cassation and Justice dismissed the referral for a preliminary decision as inadmissible, leaving the lower court's procedural posture unchanged. The dispute arose from a civil enforcement case where the Court of Bucharest sought clarification on whether sums in a debtor's account could be released for future salary payments and whether a specific destination for such funds must be established prior to the attachment of the account. The decisive legal basis involved the interpretation of Article 781(5)(c) and Article 784(1) of the Code of Civil Procedure, which govern the prohibition on releasing amounts intended for future salary rights once attached by a third-party debtor.

„Dacă, în interpretarea prevederilor art. 781 alin.

781 alin. (5) lit. c) coroborate cu cele ale art. 784 alin.
